Terms and Conditions

The Terms and Conditions ("Agreement") set forth the conditions governing your use of the MyCashier Mobile & web Application (MyCashier App). By downloading the MyCashier App and using the service, you (the User) agree to be by bound the terms of this Agreement. You further agree that where the services to be provided by MyCashier App are not regulated by the terms and conditions contained herein, they shall be regulated by customary financial App services in Nigeria.

1. Service Description

You may use the MyCashier App to save, invest, borrow money and complete bill payments for the digitally enabled products on the MyCashier App. More products may be added to the MyCashier App from time to time.

2. Onboarding and Enrolment

Upon completing the download of the MyCashier App, you will be required to provide some of your personal data for your own security. You will also be required to complete and upload any other documentation required for our record. By using the MyCashier App you represent that the information provided is true.

3. Collection of Your Information

We may collect information about you in a variety of ways. The information we may collect via the Application depends on the service you use and includes:

I. Personal Data
Demographic and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to participate in various activities related to the Application, such as chat, posting messages in comment sections or in our forums, liking posts, sending feedback, and responding to surveys. If you choose to share data about yourself via your profile, online chat, or other interactive areas of the Application, please be advised that all data you disclose in these areas is public and your data will be accessible to anyone who accesses the Application. We may also collect information related to your national identification card number and require a self-portrait to verify your identity as per the requirements of Anti-Money Laundering and Counter-Terrorism Financing legislation. That information along with other personally identifying information about you will be shared internally and may also be shared externally with our compliance, banking, aggregation and product offering partners that undertake automated review of your information: (i) against relevant government maintained sanctions lists and lists of politically exposed persons, (ii) for purposes of facial recognition against government provided identification documents, (iii) for accuracy against national databases, (iv) for confirming your identity against other relevant databases such as those maintained by companies providing credit reports, and (v) for the purpose of monitoring transactions for fraudulent and other illegal activities.

II. Location Data & Information
When you register and use the MyCashier App, we may request that you give us permission to collect your device location information. Once granted, we will use this information to carry out your address verification as required by the CBN (Central Bank of Nigeria) with the purpose of granting you full access to your account. You can revoke this permission at any time by removing the permission from your device setting. We endeavor to limit the storage of location data to your current address and the immediate vicinity of your current address.

III. Derivative Data
The information our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, as well as other interactions with the Application and other users via server log files. When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data

IV. Financial Data
Financial information, such as data related to your mobile money account and payment method that we may collect when you purchase, order, return, exchange, or request information about our services from the Application. Please note that we store only very limited, if any, financial information that we collect in line with regulatory requirements for safeguarding such information. Otherwise, all financial information is stored by our payment processor.

V. Mobile Device Access
We may request access or permission to certain features from your mobile device, including your mobile device’s camera (for the purpose of “selfies” used for identification verification), contacts (for the purpose of engaging contacts to join you on the Application), SMS messages (which we may use in the future to simplify your login to the Application), storage (for storing your profile picture for the Application), and potentially GPS (for anti-fraud, Application security purposes) and other features. If you wish to change our access or permissions, you may do so in your device’s settings. It should be noted that like other Applications, we will have access to your device fingerprint which identifies the specific device used for the Application.

VI. Mobile Device Data
Information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

VII. Push Notifications
We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in the application under the settings tab.

VIII. Third Party Data
Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Application permission to access this information.

IX. Data from Contests, Giveaways, and Surveys
Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

4. Security and Storage of your Personal Information

You are solely responsible for maintaining the security of your Mobile Device and for any authorized use of your Mobile Device to access the service. You agree to lock your Mobile Device with a password or number code whenever it is not in use so that your personal information is not accessible by others. In addition, you agree to notify us immediately in the event you become aware of any loss, theft, or unauthorized use of the MyCashier App or your Mobile Device.

We have suitable security measures in place to prevent your Personal Information from being accidentally lost or used or accessed in an unauthorized way by a third party. When your bank account information is transmitted via our Services, it will be protected by encryption technology, such as Secure Sockets Layer (SSL). In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Information on our instructions. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We have, and require our third-party service providers that receive Personal Information from us to have, a comprehensive written information security program that contains administrative, technical, and physical safeguards for our respective physical facilities and in our respective computer systems, databases, and communications networks that are reasonably designed to protect information contained within such systems from loss, misuse, or alteration.

No method of electronic transmission or storage is 100% secure. Therefore, we cannot guarantee absolute security of your Personal Information. You also play a role in protecting your Personal Information. Please safeguard your username and password for your MyCashier account and do not share them with others. If we receive instructions using your MyCashier account login information, we will consider that you have authorized the instructions. You agree to notify us immediately of any unauthorized use of your MyCashier account or any other breach of security. We reserve the right, in our sole discretion, to refuse to provide our Services, terminate MyCashier accounts, and to remove or edit content. Subject to applicable law, which might, from time to time, oblige us to store your Personal Information for a certain period of time, we will retain your Personal Information for as long as necessary to fulfil the purposes we collected it for, including the purposes of satisfying any legal, accounting, or reporting requirements.

5. Accesibility & Reversals

Once you have sent transaction instructions to us via the MyCashier App, you will not be able to reverse those instructions. It is your responsibility to correctly enter all transaction information into your Mobile Device, including transaction amounts. There may be events during which our services will be unavailable.

6. Data Privacy and User Information

You acknowledge that in connection with the use of the MyCashier App, We, your bank and the service providers may receive names, domain names, addresses, passwords, telephone and device numbers, the content of messages, data files and other data and information provided by you or from other sources in connection with the MyCashier App ("User Information"). We, your bank and the service providers will maintain reasonable safeguards to protect the information from unauthorized disclosure or use, but reserve the right to use and disclose this information as reasonably necessary to deliver the service and as otherwise permitted by law, including compliance with regulatory authorities and court orders. We, your Bank and the service providers also reserve the right to monitor the use of the MyCashier App for the purposes of verifying compliance with applicable laws and this agreement but disclaim any obligation to monitor, filter or edit any content. We also reserve the right to decline your account application or accept your money if you are unable to provide us with any information we require or for any other reason. We are not obliged to inform you of the reason why your application was declined and we will not enter into any correspondence in such circumstance.

A. Protecting Children's Privacy
Our Services are not directed or intended to be attractive, to children under the age of 18. We do not knowingly collect Personal Information from children under the age of 18. If you are under the age of 18, do not use our Services or submit any information to us.

7. Restrictions

You agree not to use the MyCashier App in or for any illegal, fraudulent, unauthorized or improper manner or purpose and agree that the MyCashier App will only be used in a manner that complies with all applicable laws, rules and regulations including all applicable state, federal and international internet, data, telecommunications, telemarketing, "spam", and import/export laws and regulations. Without limitation, you agree that you will not

  • violate the privacy rights of third parties, any third party's intellectual property rights, rights of publicity, privacy, or confidentiality, or the rights or legal obligations of any service provider or any of its clients or subscribers
  • disseminate material or data that is illegal, or of such nature that is harassing. harmful, coercive, defamatory, libelous, abusive, threatening

Further to the above, you agree that you will not attempt to

  • access any software or services for which your use has not been authorized; or
  • use or attempt to use a third party's account, or
  • interfere in any manner with the provision of the Services or the Software, the security of the MyCashier App or other customers that use the service; or
  • otherwise abuse the service or the MyCashier

8. Money Laundering and Terrorism Prohibition

You hereby agree to comply with the anti-money laundering and anti-terrorism regulations; and anti- corruption laws including but not limited to the Central Bank of Nigeria (Anti-Money Laundering and Combating the Financing of Terrorism in Banks and other Financial Institutions in Nigeria) Regulations 2013, Economic and Financial Crimes Commission (Establishment, etc.) Act 2004; Corrupt Practices and Other Related Offences Cap C31 Laws of the Federation of Nigeria 2004; Money Laundering (Prohibition) Act, 2011 and Terrorism (Prevention) Act 2011.

9. Indemnity

You hereby agree to indemnify, defend and hold us, our employees and affiliates harmless from and against any claim, expense, liability, cost, loss or damage (including cost of dispute resolution) caused directly or indirectly by your failure to comply with the terms of the agreement, your breach of representation or warranty, your failure to maintain the security of your mobile device and your negligent or intentional acts or omission in utilising the service and your violation of any applicable law, statute, or regulation relating to your use of the service.

10. Limitation of Liability

You agree that to the extent not prohibited by applicable law, We will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to damages for loss of profits, goodwill, use, data or other losses resulting from the use or the inability to use the services incurred by you or any third party arising from or related to the use of, inability to use, or the termination of the use of the MyCashier App, regardless of the form of action or claim (whether contract, tort, strict liability or otherwise), even if we have been informed of the possibility thereof. In addition to the above, we shall not be liable for inability to use the service or losses caused by events such as fires, floods, earthquakes, epidemics, strikes, unavailability of necessary utilities, blackouts, natural disasters and acts of regulatory agencies. Furthermore, MyCashier App will not be responsible for any electronic virus or viruses that you may encounter in the course of making use of this service.

11. Disclaimer of Warranties

You agree that your use of the service and all information and content (including that of third parties) is at your own risk and is provided on an as is and as available basis. We disclaim all warranties of any kind as to the use of the MyCashier App, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the MyCashier App (i) will meet your requirements, (ii) will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the service will be accurate or reliable, and (iv)any errors in the service or technology.

12. Intellectual Property

This Agreement does not transfer to you any ownership or proprietary rights in the MyCashier App or any associated content, technology, Software or any part thereof. We retain all intellectual property rights, title and interest in and to the MyCashier App and any associated content, technology, and Software. Neither you nor any user you authorize will use the MyCashier App in any manner or for any purpose that will be breach our intellectual property rights in the MyCashier App or contradict our business interest.

13. Acceptance of Agreements & Updates

Your use of the MyCashier App constitutes your acceptance of this Agreement and other amendments/Update that may be made from time to time. We will notify you of any material change the Agreement by providing a link to the revised Agreement. Such amendments shall become effective upon your receipt of notice or such later date as may be stated in the notice. If a change is made for security purposes, we may implement the change without prior notice to you. If you do not agree with the change, you may discontinue using the service. However, your continued use of the service will indicate your acceptance of and agreement to any changes to the Service.

14. Changes to our Privacy Policy

Subject to applicable law, we may revise this Privacy Policy at any time and in our sole discretion. When we revise this Privacy Policy, we will post the revised version via our Services and will update the date at the top of this Privacy Policy. The revised Privacy Policy will be effective upon posting via our Services, unless otherwise set forth therein or as otherwise required by applicable law. You are free to decide whether or not to accept a revised version of this Privacy Policy, but accepting this Privacy Policy, as revised, is required for you to continue accessing or using our Services. If you do not agree to the terms of this Privacy Policy or any revised version of this Privacy Policy, your sole recourse is to terminate your access and use of our Services. Except as otherwise expressly stated by us, your access and use of our Services are subject to the version of this Privacy Policy in effect at the time of access or use.

15. Legal Rights for events of fraud, security breach or related conduct

In the event of your participation or suspicion thereof in activities such as fraud, security breach, misuse of the MyCashier App and other prohibited activities, we shall be entitled to take all preventive or corrective actions permitted under law not limited to the restriction of your access to the service, blacklisting or otherwise freezing the BVN provided, making formal reports to the Economic and Financial Crimes Commission (EFCC), the Nigerian Police Force (NPF) and other relevant security and regulatory authorities, or otherwise commence legal action in a competent court. Further to the above, you hereby grant us authority to investigate, report, or take other actions as may be necessary to prevent or resolve the events described above and to recover the affected funds or other properties

16. Insurance

We do not provide insurance coverage for the safety of your personal effects, losses caused by fraud or security breach hence you shall be solely responsible for obtaining all insurance policies as you deem fit

17. Special Service

If you meet certain conditions, you will be entitled to the special service on the App. You hereby undertake that there shall be prompt settlement of the service as agreed by you. You will also comply with all relevant regulations including terms stipulated in this agreement or in other agreements which you execute with us and act in good faith at all times. The rules regulating this service may be reviewed or updated from time to time and shall include rules laid down by us, applicable financial institutions and regulatory authorities. It is your responsibility as a recipient of this service to stay informed on all reviews or updates that may be applicable to you.

In the event of a default in the use of this service received, we shall be entitled to take all such legal actions as we deem fit including reporting you to/engaging the services of appropriate agencies

18. Privity of Contract

The terms of this Agreement apply to you as a User only and any person who is not a party to this Agreement shall have no right by law or otherwise to enforce any of its terms

19. Record Retention

Records regarding this procedure must be maintained in accordance with MyCashier’s Data Retention Policy or as required by local or country regulations, whichever is longer.

20. Periodic Testing

Periodic testing on a risk-based frequency of the requirements of this procedure and testing criteria are determined under the AML Policy, in accordance with its requirements, and may include testing on systems upon which these controls are reliant.

21. Governing Law and Dispute Resolution

Subject to clause 12 above, this Agreement (inclusive of your rights and our obligations under this Agreement), is governed by and interpreted according to the laws of the Federal Republic of Nigeria. Any dispute that arises from the use of the service shall be resolved by direct consultation between the Parties. If the parties remain dissatisfied, the dispute shall be referred to arbitration which shall be conducted in Lagos State, Nigeria by a sole arbitrator and the proceedings shall be coordinated in accordance with the arbitration and conciliation Act, Cap A18, Laws of the Federation of Nigeria, 2004 and the accompanying extant Rules

22. Miscellaneous

We may waive enforcement of any provision of this Agreement. Any such waiver shall not affect our rights with respect to any other transaction or modify the terms of this Agreement. No waiver of any breach of this Agreement shall constitute a waiver of any prior or subsequent breach of this Agreement. In the event that any provision of this Agreement is held to be unenforceable or invalid by any court or regulatory authority of competent jurisdiction, the validity and enforceability of the remaining provisions shall not be affected, and in lieu of such invalid or unenforceable provision there shall be added automatically, as part of this Agreement, a provision as similar in terms as may be valid and enforceable, if possible

23. Loan Terms

The terms below is applicable to customers using any of the loans service on MyCashier App.

  • In case of default, interest will/may be capitalized, and you shall be liable to pay accrued full interest plus default rate of 2% monthly until payment is finally achieved. The total cost incurred on recovery will also be borne by the customer.
  • We reserve the right to recover any outstanding principal, interest and accrued default interest by any means including (reporting to your employer, law enforcement agencies, credit bureau and accessing funds from other accounts linked to your BVN) in the event of a default.
  • Also, we may part or full liquidate your savings and investments portfolio with us to set-off your outstanding loan (Overdraft, Nano loan, payday loan or any other loan you have). where this is not sufficient to recover all outstanding loan, we reserve the right to recover by any means as indicated above.
  • Management fee which included processing & insurance fee is deducted from the principal amount before disbursement and the prescribed merchant fee is payable monthly.
  • Repayment is via direct debit/standing order instruction set up using any of our third party payment gateways and or via cheques collected on your salary account and or other accounts provided & you must ensure account is sufficiently funded for repayment on due date.
  • We reserve the right to contact your guarantor and /or present his /her cheques/enforce a direct debit mandate without recourse to you and /or your guarantor in the event a guarantor is presented as part of the loan documentation.
  • You must notify us immediately your salary account details changes, and, in the event, you have left your current employer at the time of loan disbursement or in the event of an exit from employment with supporting documentary evidence.
  • Repayment mandate (Direct Debit Mandate) activation and confirmation may take up to 48 work hours from your bank and your loan disbursement is subject to successful activation of the direct debit mandate from your nominated bank. Incorrectly filled and/or signed/ execution of repayment mandate may lead to a loan decline and loan request will not be processed.
  • You are required to confirm the repayment mandate when your nominated bank contacts you either via telephone or email. Failure to confirm the repayment mandate (Direct Debit Mandate form) will lead to loan decline
  • Your decision to progress with the loan application/offer indicates your acceptance to the loan offer unconditionally. Having read and understood the terms and condition therein, you take full responsibility to fulfill my loan commitments towards MyCashier (Fast Point Integrated Limited) and you hereby authorize MyCashier App (Fast Point Integrated Limited) to debit my salary account and any other of my accounts for the monthly principal and interest element of my loan repayment till full liquidation .

23. Restrictions & Termination

We may restrict, terminate or suspend your access to MyCashier App at any time without giving you prior notice if we observe that your account is found to be fraudulent. Where this occurs, we will immediately shut down your records and return any balance in your wallet to your Bank Account. In such instance, you will not be able to use MyCashier Account or any of our related Services.
